NIW RECOMMENDATION LETTER

When writing a recommendation letter for NIW, the most important thing is to fully understand that it serves as an expert testimony, not just a compliment. The content and quality are the primary components of the approval requirements of NIW cases. For these reasons, we provide all of the recommendation letter drafts for our clients. Below is the more detailed information about recommendation letters that have compelling evidence presented from Administrative Appeals Office (AAO) cases.

  • First, the referee has not co-authored with the applicant, but he or she is in influential position and has achievements in the field.
  • Second, the referee must describe his or her relationship with the applicant realistically. While, it does not matter whether he or she knows the applicant personally or not, as a referee, it is more important to note in detail that he or she is well informed of the applicant’s research findings.
  • Third, the referee must objectively explain why the findings are important.
  • Fourth, it is necessary to explain how the applicant’s research results will practically affect the research field.

On the contrary, abstract and unclear compliments about the potential of the applicant are unnecessary components.

In particular, if the NIW applicant is a researcher engaged in academia, the applicant is recommended to receive a letter indicating that the research has been practically used from a director or Principal Investigator. This is a good way to indirectly prove that the influence of the applicant’s research is acknowledged by the expert group.

When the applicant receives recommendation letters from the industry, the position of the referee acts as a variable, since his or her work experience is included in the letter. Thus, it is preferable that a referee has work or collaboration experiences with government agencies.

It is also helpful to receive a recommendation letter which states that the applicant's research is industrially applicable from a supervisor in the related entity. This can logically prove that granting the applicant a legal permanent residence is beneficial to the national interest of the United States.
